1.2 General sales and delivery conditions apply to all agreements with Cachfires.com, CVR number DK34607907, regarding the sale and delivery of environmentally friendly fireplaces to business customers.

2. Terms and Conditions

2.1 These conditions, together with Cachfires.com's offers and order confirmations, constitute the entire basis of the agreement for the sale and delivery of products by Cachfires.com. Customer purchase conditions printed on orders or otherwise communicated to Cachfires.com do not form part of the agreement.

2.2 Changes to and supplements to the basis of the agreement are only valid if the parties have agreed to them in writing.

3. Price and Payment

3.1 The price for products and spare parts follows Cachfires.com's applicable price list at the time Cachfires.com confirms the customer's order, unless otherwise agreed in writing. All prices are exclusive of VAT. However, the price lists will indicate an indicative retail price including UK VAT at 20%.

3.2 The customer must pay all invoices for products and spare parts within 30 days netto (it requires that your company has been established for more than one year, and our insurance partner Atradius validates credit) unless otherwise agreed in writing.

4. Offers, Orders, and Order Confirmations

4.1 An offer sent by Cachfires.com is valid for 30 days from the date the offer is dated unless otherwise stated in the offer. Acceptance of an offer received by Cachfires.com after the expiration of the acceptance period is not binding on Cachfires.com unless we notify the customer otherwise.

4.2 The customer must submit orders for products or spare parts to Cachfires.com in writing or place an order manually on the website.

4.3 Cachfires.com aims to send confirmation or rejection of an order for products or spare parts to the customer in writing no later than 1 working day after receiving the order. Confirmations and rejections of orders must be in writing to bind Cachfires.com.

4.4 The customer cannot change a placed order for products or spare parts without Cachfires.com's written acceptance.

4.5 If Cachfires.com's confirmation of an order for products or spare parts does not match the customer's order or the basis of the agreement, and the customer does not wish to accept the conflicting terms, the customer must notify Cachfires.com in writing no later than 1 working day after receiving the order confirmation. Otherwise, the customer is bound by the order confirmation.

4.6 In the unlikely event that the goods are no longer available, or we have made a pricing error, we will inform the customer. In such a case, the customer will not receive an email confirming acceptance of the order, and there will be no contract between the customer and Cachfires.com.

4.7 Product images on this website are for guidance only. The received goods may differ slightly from the image shown on the website and will not include any of the accessories depicted unless stated in the product specification. While items may be shown assembled, they may require assembly upon delivery.

4.8 We have made every effort to display the colors of our products as accurately as possible on this website. However, we cannot guarantee that your screen's display of any color accurately reflects the color of the actual goods.

4.9 Although we try to be as accurate as possible, all information is approximate and provided in good faith. Typographical errors in connection with prices and information on the website and in price lists are reserved.

4.10 This contract is governed by Danish law.

4.11 By placing an order with Cachfires.com, the customer accepts these terms as well as our privacy policy and the terms of use of the website.

5. Delivery and Shipping Costs

5.1 Cachfires.com delivers all sold products and spare parts within 1-2 business days (UK) and 1-6 business days (EU) if the ordered goods are in stock. If one or more of the items are not in stock, the delivery time will be stated on the website or we will inform you via email.

5.2 Cachfires.com delivers all sold products and spare parts at the time specified in the order confirmation. Cachfires.com has the right to deliver before the agreed delivery time unless the parties have agreed otherwise.

5.3 You must inspect all products, spare parts, and related services upon delivery. If you discover an error or defect that you wish to complain about, it must be immediately reported in writing to Cachfires.com. If an error or defect that you discover or should have discovered is not immediately reported in writing to Cachfires.com, it cannot be asserted later.

5.4 We deliver the goods to the address you specify in the order. You must be at the address to receive the delivery of your order, which is usually between 9am and 6pm Monday to Friday. We are not responsible for loss or damage if you instruct the delivery company to leave the goods unattended.

5.5 Most of our products are relatively heavy items, and you may be asked to assist the driver.

5.6 Disposal of packaging materials is your responsibility.

5.7 If there is no one to receive the order on the scheduled delivery date, the goods may be returned to our warehouse, and we reserve the right to charge a redelivery fee.

5.8 If you change the delivery address after the goods have been dispatched to you, we reserve the right to pass on any additional charges from our carriers to redirect your delivery to you.

5.9 If the goods are lost or damaged during transport, please notify us immediately.

5.10 For dropshipping, we deliver small packages to your customer's mailbox, outside the door, or to a pick-up point. For larger packages delivered on a pallet, we only offer curb delivery.

5.11 Free delivery is available on orders where the total netto price is more than 4000€. Additional fees may apply if you mix from a range of different assortments, as these may need to be treated as individual orders. You can see our shipping costs here.

5.12 Otherwise, always adhere to applicable CMR Convention.

6. Cancellations and Returns

6.1 Cachfires.com does not accept returns unless it is agreed in writing and a maximum of 6 months after receipt of the order. The goods must be returned in the original packaging, and unused. If you exercise your right of return, we will charge an administration fee of 20% of the purchase price (excluding claims or defects on our part). You are responsible for the costs and risk of returning the goods.

7. Warranty

7.1 Cachfires.com guarantees that products and spare parts are free from significant defects and flaws in design and materials for 12 months after delivery. The warranty complies with Danish law, which states that all products have a 1-year warranty and a 2-year extended complaint period in case of malfunctions during this period.

7.2 Cachfires.com's warranty does not cover wear parts such as burners and defects or faults caused by: (i) normal wear and tear, (ii) storage, installation, use, or maintenance contrary to Cachfires.com's instructions or common practice, (iii) repair or modification performed by anyone other than Cachfires.com, and (iv) other conditions for which Cachfires.com is not responsible.

7.3 If you discover an error or defect during the warranty period that you wish to complain about, it must be immediately reported in writing to Cachfires.com. If an error or defect that you discover or should have discovered is not immediately reported in writing to Cachfires.com, it cannot be asserted later. The customer must provide Cachfires.com with the information about a reported error or defect that Cachfires.com requests.

7.4 Within a reasonable time after Cachfires.com has received notice from you of an error or defect and examined the claim, Cachfires.com will notify you whether the error or defect is covered by the warranty. Upon request, you must send defective parts to Cachfires.com. You bear the costs and risks of parts during transport to Cachfires.com. Cachfires.com bears the costs and risks of parts during transport to you and Cachfires.com if the error or defect is covered by the warranty.

7.5 Within a reasonable time after Cachfires.com has given notice to the customer under section 7.4 that an error or defect is covered by the warranty, Cachfires.com remedies the error or defect by: (i) replacing or repairing defective parts, or (ii) sending parts to the customer for the customer's own replacement or repair.

7.6 If Cachfires.com fails to remedy an error or defect covered by the warranty within a reasonable time after Cachfires.com has given notice to the customer under section 7.4, for reasons for which the customer is not responsible, and the error or defect is not remedied within a reasonable period of at least 15 days, the customer may terminate the order or orders affected by the error or defect without notice by written notice to Cachfires.com. The customer has no other rights in case of errors or defects in products or spare parts than those expressly stated in section 7.

7.7 If a product is no longer available, we offer an alternative. However, our responsibility will only be to replace the defective goods, and we cannot guarantee an exact match. In this case, you have the option to get a refund.

7.8 If we replace defective goods, you are responsible for the disposal of the defective item if we do not wish to have it returned.

7.9 We cannot guarantee an exact color match due to the nature of the product.

7.10 All products are manufactured within tolerances of +/- 1.5 mm.

8. Force Majeure

8.1 The following circumstances result in force majeure when they occur after the agreement's conclusion and prevent its fulfillment:

8.2 Labor disputes, strikes, lockouts, and any other circumstance beyond the parties' control, such as fire, epidemic, war, unforeseen military call-ups of a similar extent, sabotage acts, confiscation, currency restrictions, riots, lack of transportation, general shortage of goods, fuel restrictions, and deficiencies in deliveries from subcontractors, or delays in such deliveries due to any of the circumstances mentioned in this point.

8.3 Products sold on this website are designed to comply with all relevant laws in the UK, Germany, Denmark, Spain, Sweden, and Norway. We cannot guarantee or represent that they comply with any legal requirements outside the UK, Germany, Denmark, Spain, Sweden, and Norway.

8.4 We do not assume responsibility for any consequential loss of profit or indirect loss. Therefore, assembly of the goods should not be ordered until they have been received and inspected.

8.5 The party wishing to invoke any of the aforementioned circumstances must promptly notify the other party of the event that has occurred and when it is expected to cease.

8.6 Both parties are entitled, by written notice to the other, to terminate the agreement when its fulfillment within a reasonable time becomes impossible due to any of the circumstances mentioned in section 8.2.

9. Confidentiality

9.1 You may not disclose or use or enable others to use Cachfires.com's trade secrets or other information of any kind that is not publicly available.

9.2 You may not unduly obtain or attempt to obtain knowledge of or access to Cachfires.com's confidential information as described in section 9.1. You must handle and store the information carefully to prevent it from accidentally becoming known to others.

9.3 Your obligations under sections 9.1-9.2 apply during the parties' business dealings and without time limit after the end of the business dealings, regardless of the reason for termination.

10. Intellectual Property Rights

10.1 The full ownership of all intellectual property rights relating to products, spare parts, and related services, including patents, designs, trademarks, and copyrights, belongs to Cachfires.com.

10.2 If delivered products or spare parts infringe third-party intellectual property rights, Cachfires.com must, at its own expense: (i) ensure the customer's right to continue using the infringing products or spare parts, (ii) modify the infringing products or spare parts so that they no longer infringe, (iii) replace the infringing products or spare parts with ones that do not infringe, or (iv) repurchase the infringing products or spare parts at the original net purchase price with a deduction of 50% per year since delivery. The customer has no other rights in case of infringement of third-party intellectual property rights in products or spare parts.

11. Processing of Personal Data

11.1 Cachfires.com processes personal data in accordance with the General Data Protection Regulation and the Data Protection Act. Information about the customer's name, email, phone number, etc., is used solely in connection with the customer's order and communication with the customer.

11.2 Cachfires.com complies with the data subjects' rights (including the right to access, rectification, erasure, restriction of processing, objection, data portability, complaint, and the right not to be subject to a decision based solely on automated processing, including profiling).

11.3 Cachfires.com retains the information for as long as necessary for the purpose for which the information is processed. Cachfires.com does not disclose, sell, or otherwise transfer information to third parties unless the customer has given consent.

11.4 If the customer wishes to obtain information about which data is being processed, request data deletion, or correction, the customer can contact info@cachfires.com.

12. Applicable Law and Jurisdiction

12.1 The parties' business relationship is subject to Danish law in all respects.

12.2 Any dispute arising in connection with the parties' business relationship shall be settled by a Danish court.
